Choose a VA decision-review option
Practical guide
At a glance
A Higher-Level Review cannot consider new evidence. A Supplemental Claim requires new and relevant evidence. Choosing the wrong route can leave your strongest material outside the review.
Who this is for
Veterans or survivors who disagree with a VA benefit decision while living in Thailand.
Eligibility and coverage rules
Most Higher-Level Review and Board Appeal requests have a one-year deadline measured from the date on the decision letter. A Supplemental Claim can generally be filed later, but filing within a year can matter to preserving the effective date. Read your decision notice for the review options and deadlines that apply.
Steps to take
- Download the full decision and identify the issue, reasons for denial, evidence considered and deadline.
- Decide whether the problem is an error in the existing record or whether new and relevant evidence is needed; get accredited help if unsure.
- Select the appropriate review option and save proof of submission.
Important limits
- A Board direct review also excludes new evidence; its evidence-submission and hearing options differ.
- Contested claims can have a 60-day Board deadline rather than one year.
- After a Board decision, a Court appeal generally has a 120-day deadline and is filed with the Court, not VA. This is distinct from medical-claim reimbursement deadlines.
Confirm for your circumstances
The correct lane and effective-date consequences depend on your procedural history. Obtain individual advice for pending deadlines, legacy appeals or contested claims.
