Thailand resident instructions
Check tax treatment by benefit type
Practical guide
At a glance
US Social Security, government-service pensions, private pensions and VA disability compensation cannot safely be put in a single 'retirement income' bucket.
Who this is for
Households receiving a mix of SSA, DFAS, OPM, VA, IRA or employer-plan payments.
Eligibility and coverage rules
- Article 20(2) of the US–Thailand treaty assigns covered Social Security benefits to taxation only in the paying state. For US Social Security, that means US taxing jurisdiction, not a promise that the US will assess tax on every recipient.
- Article 21(2) generally assigns government-service pensions to the paying state, but contains an exception for a recipient who is both resident and national of the other state. Its business-service exception also matters.
- The treaty's saving clause can preserve US taxation of US citizens despite an ordinary pension article. Government-service exceptions interact with nationality and immigrant status. Dual nationality, Thai permanent-residence status, survivor payments and unusual pension arrangements deserve individual review.
- VA disability benefits are excluded from US gross income. That US rule alone does not establish Thai treatment. This guide does not classify every VA award under a treaty article or promise a Thai exemption.
- The foreign earned income exclusion does not cover pensions, annuities or Social Security. Living abroad for 330 days does not turn a pension into foreign earned income.
Steps to take
- List the legal payer and exact benefit type from each award letter and tax statement, using the award letter and tax statement.
- Separate government-service annuities from private savings distributions, including TSP/IRA questions that require their own classification.
- Ask the adviser to state the treaty article, saving-clause analysis, nationality/residence assumptions and required return disclosures in writing.
- Keep the official treaty and supporting benefit statements with the year's tax records; assess credits only after determining which country may tax the specific income.
Important limits
'The treaty prevents double taxation' does not mean neither country may tax you, and a credit is not automatically dollar-for-dollar relief for every payment.
