Prepare and claim survivor benefits
Practical guide
At a glance
VA DIC, military SBP, a federal civilian survivor annuity and Social Security survivors benefits are different programs. None should be assumed from the existence of another.
Who this is for
Couples living in Thailand, especially those with a non-US-citizen spouse or multiple retirement systems.
Eligibility and coverage rules
- DIC requires the survivor's relationship rules and a qualifying death or disability history. A service-connected cause of death is one route; certain continuous total-disability periods provide another. The familiar ten-year rule is not the only route, and it is not a marriage-duration shorthand.
- SBP depends on its own coverage and beneficiary rules. The SBP–DIC offset ended for eligible surviving spouses effective January 2023. Being able to receive both does not establish entitlement to either.
- A federal civilian survivor annuity belongs on a separate OPM checklist. Social Security must separately decide the survivor's entitlement and whether payments can continue abroad.
Steps to take
- Record each payer, benefit name, claim or retirement reference, survivor election and where the documents are securely stored. Do not place SSNs, bank details or private records on a public website.
- Verify current beneficiary and survivor coverage with each payer, particularly after marriage, divorce or a previous spouse's death. Do not assume an ordinary beneficiary designation creates a survivor annuity.
- Prepare accessible marriage, divorce and service/retirement records, plus instructions for obtaining death certificates and translations when needed.
- After a death, notify each payer promptly, ask how to handle later deposits and submit the separate survivor claims. Do not assume the deceased person's payments can simply continue into the household account.
Important limits
A veteran need not have been rated totally disabled for ten years for every possible DIC claim. Conversely, a high disability rating does not guarantee a surviving spouse's claim.
